§ 1 acomplishing a contract
With correct booking and acknowledgement of the data by the company DTS, contract of carriage is achieved. If the customer gives incomplete or faulty data a contract will not be achieved. DTS is authorised to let drives be executed by service providers.
§ 2 Subject Matter of the Cotract
The travel service results from the description of the booking. DTS, however, has to reserve the right to change the rendered services as long as the change does not concern the core of the services . Posterior changes of
the service’s price are however precluded. The content of services are each described in the current guideline. The carriage of no more than one child until 3 years per adult is included in the price. The prices are valid for one pick-up address and a one-way journey. The price includes one suitcase and hand baggage for each person.
2.1 Due to the general cargo, reasonable delays (up to 45 minutes) can not be excluded when picking-up customers from the airport. Significant delays of arriving flights relieve DTS from the duty of the agreed pick-up. Otherwise
the indicated arrival times in the booking document are binding for us. The
p assangers are obligated to notify us in writing about bookings made after placing the order. If not told in a writing our duty of carriage expires.
2.2 Exceptional circumstances like strikes, civilian unrest, natural and other desasters, board decision or atmospheric conditions can only be counterbalanced up to a certain point (if at all) by DTS so that the customer even has to accept longer waiting times.
2.3 The fixing of the pick-up times are incumbent of the company DTS. They result from length of the ride as well as the requirements of the charter and scheduled airlines.
2.4 The passenger´s baggage is transported free of charge within the framework of the conditions of charter and scheduled airlines . In case of excess baggage there are surcharges which are displayed in our price list. Non-declared excess baggage can only be transported in exceptional cases and by paying an additional charge.
2.5 For transfers booked for pick-up at the airport, the contracted transfer provider will allow a waiting time of 30 minutes free of
charge. The waiting time begins from the official landing time indicated by the airport authority. In case that the arrival time is
earlier than the scheduled arriving time the client has to wait for the driver. The waiting time is based on the scheduled landing time provided by the airport authority and calculated from the original arriving time. Transfers that are booked for pick-up at a railway station – the waiting time is 15 minutes free of charge. In case of earlier train arrival times, the same procedure applies like stated before.
2.6 Fees for no-show
If the customer does not show up at the predetermined pick-up time and/or meeting point, and they can’t be contacted personally or via telephone within the waiting time (§ 2.5) and he did not inform the dedicated transfer provider for his journey, either in writing or via telephone in regards to his delay, the full transfer cost (100%) will be charged as a no-show fee.
2.7 Fees for waiting periods
If the customer contacts the contracted transfer provider by telephone within the free-of-charge waiting period and requests that he/she would like to continue with the booked transfer, the following extra fees will apply according to the chosen payment method after the free-of-charge waiting period comes to an end:
Limousine
• 1 – 30 minutes after the free-of-charge waiting period: 25.00 € (incl. VAT)
• After 30 minutes, every 15 minutes will be charged at 12.50 € (incl. VAT)
• Any extra parking fees will be charged
Van
• 1 – 30 minutes after the free-of-charge waiting period: 55.00 € (incl. VAT)
• After 30 minutes, every 15 minutes will be charged at 12.50 € (incl. VAT)
• Any extra parking fees will be charged
§ 3 Price
The price which is indicated in each current price list is to be paid cash to our service provider at the start of the transfer drive.
§ 4 Rescission and meeting place at the airport
Both contracting parties are entitled to cancel the drive according to legal regulations. Cancelation fees will not be charged if the client´s cancelation is on hand 24 hours before the start of the ride. Every cancelation which is received later than 24 hours will cause a cancelation fee amounting to the valid fare. If the customer does not appear at all, the entire fare will have to be paid but the customer will stay reserved to demonstrate that the actual accured damage is lower. The passenger is incumbent on causing the receipt of the cancelation. Each agreed meeting place at the airport is binding.
§ 5 Guarantee
The company DTS is liable within the framework of due diligence of an orderly businessman for the conscientious planning of the agreed rides the meticulous choice and monitoring of the service providers and the proper delivery of the travel services. So far as there exists an insurance coverage within the framework of a legally required liability insurance, DTS is liable to the customer in case of damage within the framework of the legal regulations. In so far as the liability insurance is compulsory, the liability of DTS is limited in its height to the triple of the agreed total fare. Apart from that, DTS is only liable for gross fault. It is however also liable for simple fault, when it violates a contractually essential obligation that has a special meaning for the customer. The customer has the obligation to inform DTS immediately about possible complaints regarding the service at the latest 14 days after the ride.
§6 Saving Clause
Should one of the previous clauses be void, the effectiveness of the contract is not changed. Instead of void clauses the legal regulations apply.
